NYAMIRA, Kenya, Feb 16 – The Nyamira High Court has quashed an election petition challenging Governor Amos Nyaribo’s victory in the August 202 General Election.
Justice Kimondo Kanyi ruled in the petition that was filed by a voter, Dennis Ayiera that the elections were conducted freely, fairly and according to the Constitution.
The Court made an admission that there can never be a perfect election exercise and that the gubernatorial polls could not be expected to meet mathematical perfection.
The Court also absolved Nyaribo from the blame that he used Leonard Mogaru, a public servant as his chief agent, ruling that the petitioner failed to proof the claims of corruption beyond reasonable doubt.
The petition was filed on September 7, 2022 and was seeking to overturn the election of governor Amos Nyaribo as governor of Nyamira County.
The court ruled that the evidence provided by petitioner Dennis Ayiera was not enough to compel it overturn the gubernatorial results announced by the Independent Electoral and Boundaries Commission (IEBC) where he beat his closest challenger Walter Nyambati of United democratic Alliance (UDA) by 32, 809 votes in last year’s general elections
He also claimed that there was an alteration of vote tallies, especially in form 37C, an act that led to Governor Nyaribo who was listed as the first respondent, unfairly winning the polls.
Nyaribo was announced winner with 82,090 votes against Mr Nyambati’s 49, 281.
In his affidavit, the petitioner alleged that Mr Nyaribo’s election was not conducted in accordance with the law and that the IEBC did not conduct a free, fair and transparent elections.
He also claimed that there was an alteration of vote tallies, especially in form 37C, an act that led to Governor Nyaribo who was listed as the first respondent, unfairly winning the polls.
Nyamira Governor Amos Nyaribo thanked God for making him emerge victorious in a petition that was challenging his August election.
“Thank you, the people of Nyamira county. God has and will always be on our side. I will deliver as promised, I will stick to the plan and the promises,” the governor added.
