NAIROBI, Kenya, Feb 5 – Over 190 members of Dupoto Darfur Settlement scheme are in court seeking orders to stop Kenya Railway Corporation and the Lands Cabinet Secretary from taking possession of over 93 acres of land in Embakasi.
The sections of Members of the Association including women with children and old men who streamed to Milimani Law Court said the land they have occupied for many years was taken away by KRC for the construction of the Standard Gauge Railway but they have not been compensated.
The Association members were initially represented by Senior Counsel Thomas Letangule who prepared documents for compensation, but when payment was almost being made by KRC the process was hijacked by another lawyer who never knew members of the association and eventually no money was paid to occupants of the land.
In their court documents they have sworn several affidavits to demonstrate how they were conned by middlemen this loosing Sh2.47 billion meant for compensation.
The aggrieved families want the court to issue an injunction against the management of KRC, CS lands, NLC pending the hearing and determination of the matter before court.
They also want the Law Society of Kenya (LSK) to investigate lawyers who hijacked the process midway and recommend their prosecution.
The application field under a certificate of urgency had been placed before Environment and Lands Court for the presiding Judge to give directions.
