NAIROBI, Kenya Aug 21 – Healthcare workers in Nairobi have received additional legal protection under the new Nairobi City County Health Services and Management Act, 2026.
The law guarantees healthcare personnel the right to a safe working environment designed to minimise the risk of disease transmission, injury and damage to their health and property.
It also recognises the right of healthcare workers to refuse treatment of patients who are physically or verbally abusive or sexually harassing.
However, the protection is subject to an important exception.
A healthcare worker cannot refuse emergency treatment where no alternative healthcare provider is available.
The provision seeks to strike a balance between patientsβ right to receive care and the safety and dignity of healthcare workers.
The law also introduces mandatory quality-management systems, regular inspections and audits of health facilities.
Nairobi County will additionally be required to strengthen digital health information systems and mechanisms for community participation.
The measures form part of a broader overhaul of the county’s health system following the commencement of the new law on August 19.
