NAIROBI, Kenya, Feb 8 — The High Court in Nairobi has ordered the recovery of Sh7 million, part of kickbacks paid in the Sh283 million Nairobi cemetery land saga reported in 2010.
Justice Esther Maina ordered Dr. Daniel Nguku and Janet Mulwa to pay the sum with accrued interest at the rate of 12 per cent per annum in a decision rendered on Thursday.
An Ethics and Anti-Corruption Commission (EACC) investigation revealed that City Hall officials and their cronies bagged Sh173 million having only paid Sh110 million for the land in question.
EACC also contested the inflated value of the land saying the price of the 48.30ha parcel stood at Sh30 million at the time as per valuation by the Ministry of Lands.
“Sh173 million [was] shared among Government officials through 26 law firms and proxy companies,” EACC stated in a summary following Thursday’s ruling.
Thursday’s judgement marked the fifth such recovery in the case. In similar orders delivered on 16 November 2023, the court ordered Joseph Owino to repay Sh10 million obtained in kickbacks and accrued interest at the rate of 12 per cent annually.
EACC said it had completed a total of five of eight recovery suits on the matter.
The court will render the sixth judgement on February 28.
